1. Agreement to these terms

By accessing or using https://infosecgovernance.com (the "site"), you agree to be bound by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with any part of these terms, please do not use the site.

2. What these terms cover

These terms govern your use of this website only. They do not govern any consulting services we provide to you. Services are delivered under a separate written engagement agreement — a statement of work, master services agreement or equivalent — which takes precedence over these terms in the event of any conflict relating to those services.

3. Permitted use of this site

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and view the material on this site for your own internal, informational and non-commercial purposes. You may print or download extracts for that purpose. Under this licence you may not:

  • republish, redistribute or commercially exploit material from the site;
  • reproduce material as part of a competing or derivative service;
  • remove any copyright, trade mark or other proprietary notice;
  • use automated systems to scrape, harvest or systematically extract content, other than well-behaved search engine crawlers acting in accordance with our robots.txt file; or
  • attempt to decompile, reverse engineer or otherwise derive the source of any software used to operate the site.

This licence terminates automatically if you breach any of these restrictions.

4. Intellectual property

All content on this site — including text, graphics, logos, icons, page layout, structure and underlying code — is owned by or licensed to InfoSec Governance and is protected by copyright, trade mark and other intellectual property laws. Nothing on this site transfers any ownership right to you.

5. Information, not advice

The content on this site is provided for general information about our services. It is not professional, legal, regulatory or security advice, and it is not tailored to your circumstances. You should not act, or refrain from acting, on the basis of anything on this site without obtaining advice appropriate to your own situation. Any reliance you place on this content is at your own risk.

6. Engagements and proposals

Descriptions of services on this site are indicative and do not constitute an offer capable of acceptance. No engagement arises, and no obligation is created on either side, until we have both signed a written engagement agreement. Any timescales, deliverables or outcomes described on this site are illustrative and are agreed specifically in that agreement.

7. Acceptable use

You agree not to use this site to:

  • attempt to gain unauthorised access to the site, its server, or any connected system;
  • probe, scan or test the vulnerability of the site without our prior written permission;
  • introduce malicious code, or interfere with the site's normal operation;
  • impose an unreasonable load on our infrastructure, including through denial-of-service activity;
  • submit false, misleading, abusive or unlawful content through our contact form; or
  • use our contact form to send unsolicited commercial messages.

We take security research seriously and welcome responsible disclosure. If you believe you have found a vulnerability in this site, please contact us at sales@infosecgovernance.com before taking any further action, and give us a reasonable opportunity to respond.

8. Third-party links and services

This site links to third-party websites and services, including our scheduling provider. Those are provided for convenience only. We do not control them, we are not responsible for their content, availability or practices, and a link does not imply endorsement. Your use of any third-party service is governed by that provider's own terms and privacy policy.

9. Availability

We aim to keep the site available but do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, including maintenance, without notice and without liability to you.

10. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, InfoSec Governance disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the content is accurate, complete, current or free from error.

11. Limitation of liability

To the fullest extent permitted by law, InfoSec Governance and its personnel and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of — or inability to use — this site, whether based in contract, tort, negligence or any other legal theory.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

12. Indemnity

You agree to indemnify and hold harmless InfoSec Governance against any claims, losses, liabilities and reasonable costs arising from your breach of these terms or your unlawful use of the site.

13. Privacy

Your use of this site is also governed by our Privacy Policy and Cookie Policy, which form part of these terms.

14. Changes to these terms

We may revise these terms at any time by updating this page. The version in force is the one published here at the time you access the site, and the "last updated" date shows when it was most recently changed. Continued use of the site after a change constitutes acceptance of the revised terms.

15. Governing law

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the jurisdiction in which InfoSec Governance is established. You irrevocably submit to the exclusive jurisdiction of the courts of that jurisdiction.

If any provision of these terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, or severed, and the remaining provisions shall continue in full force.
